Terms of Service

1. Who we are and acceptance of these terms

The DaniLink service is provided by Danicode Solutions SRL, VAT no. RO33124633, registered office at Str. Colina Măgurii nr. 16, Măgura, Bacău County, Romania ("we", "us"). By creating an account and using DaniLink you agree to these Terms of Service. If you do not agree to them, do not use the service. You can reach us at any time through the contact page.

2. Minimum age

You must be at least 18 years old to create a DaniLink account. By creating an account you confirm that you meet this age requirement. An account is only needed to initiate control — you can receive assistance through DaniLink without an account and without any age condition.

3. Account required

Starting a remote-control session requires a DaniLink account. Anyone can view and control a session from a browser, but initiating a control connection requires sign-in — there is no anonymous control access. You are responsible for the activity carried out through your account.

4. Passwordless sign-in

Authentication uses a sign-in link sent to your email address (a magic link) — there is no password to set or remember. You are responsible for keeping access to the email address associated with your account.

5. Automatic updates

The host application may update itself automatically to the latest digitally signed version, for security fixes and improvements. We may require a minimum version to use the service; it is your responsibility to run a supported version.

6. Responsible use

DaniLink is provided for personal use, or for licensed commercial use as described on the Pricing page. You are responsible for having the right to access any device you connect to, and for how you use the remote access granted to you. Every session starts only after explicit confirmation (Accept) on the controlled device.

In particular, you must not:

• access, or attempt to access, devices without their owner's consent;
• bypass, or attempt to bypass, the Accept confirmation or any other security measure of the service;
• use the service to distribute malicious software, commit fraud, or carry out any illegal activity;
• send repeated, unsolicited connection requests (harassment or spam);
• resell the service, or offer it as your own, without our written consent.

7. Plans, availability, and changes to the service

The features of each plan, free or paid, are those described on the Pricing page. The service is provided on an "as available" basis: we do not guarantee any availability level (SLA), especially for the free plan. We may modify, suspend, or discontinue the service or parts of it; for significant changes that adversely affect paying subscribers we will give reasonable advance notice.

8. Suspension and termination

We may suspend or close your account if you breach these terms, if its use creates security or legal risks, or if the law requires us to; where reasonably possible, we will notify you in advance. You may close your account at any time from the account portal, and the associated data will be deleted in accordance with the Privacy Policy.

9. No warranties ("as is")

To the maximum extent permitted by law, DaniLink is provided "as is" and "as available", without any express or implied warranty — including, but not limited to, warranties of uninterrupted operation, freedom from errors, fitness for a particular purpose, or compatibility with your equipment. We do not guarantee that a remote connection can be established or maintained under all network conditions. This section does not affect any warranties you are entitled to by law as a consumer.

10. Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for indirect or unforeseeable damages — such as loss of profit, loss of data, loss of business opportunities, or business interruption; (b) our total, aggregate liability for any claims related to the service is limited to the amounts you paid to Danicode Solutions SRL for the service in the 12 months preceding the event giving rise to the claim; (c) we are not liable for the actions of people you allowed access — through the Accept confirmation, by authorizing unattended access, or by making your account available to someone else.

Nothing in these terms excludes or limits our liability for intent or gross negligence, for death or personal injury, or any other liability that cannot be excluded or limited under applicable law. Your statutory rights as a consumer remain unaffected.

11. Indemnification

If a third party raises claims against us because of how you used the service in breach of these terms or of the law — for example, accessing a device without the right to do so — you will compensate us for the resulting damages and reasonable costs, to the extent they are attributable to you. This obligation applies only within the limits allowed by consumer-protection law.

12. Changes to these terms

We may update these terms. For significant changes we will notify you at least 15 days in advance, by email or through the application. Continuing to use the service after the new version takes effect means you accept it; if you do not agree, you may close your account before that date.

13. Governing law and disputes

These terms are governed by Romanian law, and disputes fall under the jurisdiction of the courts of Romania. If you are a consumer, you continue to benefit from the mandatory protection rules of your country of residence, and you may turn to the Romanian National Authority for Consumer Protection (ANPC) or to an alternative dispute resolution (ADR) body.

14. Miscellaneous

If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in force. These terms, together with the Privacy Policy and the plan descriptions on the Pricing page, constitute the entire agreement between you and us regarding the service. We may transfer our rights and obligations under these terms as part of a reorganization or sale of the business, with equivalent protections maintained for you.

15. Your data

Account data is hosted in the European Union, and session content is never stored on our servers. Details on how we process data are in the Privacy Policy. You may close your account and delete your data at any time from the account portal.
